1. Introduction

These Terms and Conditions (“Terms”) govern your access to and use of the website located at https://fusionlatina.net (the “Site”), as well as all related services, tools, features, and content provided by Fusion Latina, a company duly organized and existing under the laws of the State of Illinois, with its principal place of business at 111 West Jackson Blvd, Suite 1700, Chicago, IL 60604 (“Fusion Latina,” “we,” “us,” or “our”).

By accessing or using the Site or any of our services—including but not limited to on-site activations at Hispanic soccer leagues, digital marketing campaigns, first-party data collection, geo-fenced advertising, conversational messaging (SMS/WhatsApp/email), and our proprietary Digital Retail Network (DRN)—you agree to be bound by these Terms. If you do not agree, you must not use our Site or services.

2. Eligibility

You must be at least 18 years of age and legally capable of entering into a binding contract to use our services. By using the Site, you represent and warrant that you meet these requirements.

3. Description of Services

Fusion Latina operates the largest soccer-powered Hispanic community network in the United States, with over 20 years of experience and presence in more than 3,300 independent Hispanic soccer leagues across 32 states. We provide a full-funnel marketing platform that enables brands to:

  • Activate through on-site, culturally resonant experiences at soccer events (e.g., family zones, branded fields, product sampling, and data capture);
  • Convert via geo-fenced digital advertising, conversational marketing (SMS, email, WhatsApp, AI chatbots), and double opt-in first-party data;
  • Retain through our Digital Retail Network (DRN), which links QR codes at soccer venues to league-specific microsites and Shopify-powered e-commerce storefronts for measurable, direct-to-consumer sales.

All services are provided “as is” and “as available.”

4. User Responsibilities

You agree not to:

  • Use the Site for any unlawful or fraudulent purpose;
  • Impersonate any person or entity;
  • Interfere with or disrupt the security or functionality of our systems;
  • Attempt to reverse engineer, decompile, or extract source code from any part of our platform.

5. Intellectual Property

All content, trademarks, logos, software, and materials on the Site are the exclusive property of Fusion Latina or its licensors and are protected under U.S. and international copyright, trademark, and intellectual property laws. No license is granted except as expressly stated herein.

6. Limitation of Liability

To the fullest extent permitted by applicable law, Fusion Latina shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business opportunities, arising from your use of or inability to use the Site or services—even if advised of the possibility of such damages.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. Any legal action related to these Terms shall be brought exclusively in the state or federal courts located in Cook County, Illinois.
